Teen thugs jailed for sickening attack caught on CCTV

TWO TEENAGERS have been jailed for a violent attack which was filmed on CCTV.

They were shown punching, kicking and stamping on the head of their victim as he lay helpless on the street.

Adam James Wheller and Christopher Geoffrey Wick, both 19, were both given custodial sentences at Dorchester Crown Court for what Judge Gary Burrell labelled a ‘sickening’ and ‘cowardly’ attack.

He said that the prolonged assault could have left the victim with brain damage.

It was a cowardly, sustained and extreme attack by both of you fuelled by alcohol and anger. The assault was sickening and appears to have been unprovoked

Judge Gary Burrell

Both youths admitted charges of affray and Wheller, of Honeysuckle Close, Weymouth, was sentenced to nine months at a Young Offender Institution while Wick, of Hetherly Road, Weymouth, was sentenced to six months.

Prosecutor Simon Jones said that at around 1.20am on March 15 the pair were among a group of youths picked up on CCTV in Weymouth town centre who appeared to be in confrontation with a man wearing a red top.

Mr Jones said Wheller and Wick then pursued the man through the town centre for ‘a couple of minutes’.

Describing what the CCTV footage showed, Mr Jones said: “Mr Wheller instigates the offence by tripping up the victim and both Wheller and Wick repeatedly punch the individual whilst on the ground.

“They also aim kicks at his head and Wheller at the end of the incident aims two stamps at the victim’s head.”

Mr Jones said Wheller and Wick were tracked by CCTV cameras to a nearby pub where they were later arrested but the victim of the attack was never traced. He said both teenagers claimed the man had been acting aggressively towards their group earlier in the evening to provoke the violence.

Tim Shorter, mitigating, said that one member of Wheller and Wick’s group had been involved in an earlier altercation with the victim but they accepted their actions had gone too far.

He said: “This was clearly an over-reaction to whatever this man had done.”

Mr Shorter added that, despite the apparent violence of the attack, the victim did not seek to involve the police himself.

He said that both defendants felt ‘disgust, horror, shame and mortification at what they had done.”

Judge Gary Burrell told the youths: “Town centre gratuitous violence of this degree, particularly at night, cannot possibly be tolerated.

“It was a cowardly, sustained and extreme attack by both of you fuelled by alcohol and anger. The assault was sickening and appears to have been unprovoked.”

Judge Burrell said Wheller’s actions in stamping on the man’s head could have caused brain damage or even killed him and sentenced him to nine months in custody. He said that Wick was also ‘committed’ in the attack and sentenced him to six months in a Young Offender Institution.

Judge Burrell said: “It was the ferocity of the attack and the fact that it was such a committed attack in a public place which makes this a very serious offence.”

Your headline 'Sickening' is most appropriate in this case. However, what is even more sickening is the minimal sentences passed upon these low-life!

It seems to me that the victim will be suffering long after these two are out and beating the life out of someone else.
Yet another example of the judiciary being out of step with the man in the street.

The CCTV still also shows 2 others apparently encouraging the offenders and a third seemigly walking away... were these people not at least interviewed by police?

Welcome to Weymouth. Please enjoy the facilities of Govenors Lane between East Street and Maiden Street but exercise caution outside of normal retail hours.

On the video, there appears to be THREE attackers. One in a light coloured shirt who lands a few blows, then the one in the stripey top and the hoodie who carry on the attack and kick the victim.

Quote: "He said that both defendants felt ‘disgust, horror, shame and mortification at what they had done.” Well, to me they strode off like proud peacocks, heads held high! Is that a show of 'disgust, horror and shame'?

These thugs are getting away easily with just nine months. as a victim of a gang attack before i know the lengthy effects it has on walking the streets feeling comfotable again and the feeling lasts a lot longer than just nine months. Also the other gang members in this video should be mentioned as i am sure they werent helping stop the incident. its absolutely disgusting that people can have the mentality to do such a thing. Wheller is a coward and walks behind his other gang members before pouncing on the victim whilst he has tripped him up like kids do in primary school playgrounds. Wicks also has something worng as he does no show in untill he realises the vistim is helpless. The Whellers have had a good day on the Echo papers getting their faces on the front and back pages in different lights. A nine month jail sentance where they will be able to play on an Xbox, playstation and and other perks that he would not get out of prison will feel like its a nine month holiday for the thug with extra bragging rights when he gets out seems far to little a sentance for something that will stick in the victims mind forever.

Hope the victim will be Ok, whoever he is. Another example of the effect that too much alcohol has on the youth (and older)of Weymouth. My thoughts are with the families of victim and perpetrators - who will be the ones picking up the pieces.

Yet another limp wristed sentence which will hardly have them quaking in their blood stained boots. Is this really going to deter those who want to fight on the streets. When will somebody say enough is enough and start giving 5 or 6 year sentences for this type of offence. We hear now of reduced sentences for guilty pleas how about an extended sentence for a not guilty plea which results in a conviction. How about 5 years meaning 5 years, not half and the rest on parole. Let parole start when they are released after their full term, if they misbehave put them back inside. Et alia . . . . .

Judge Burrell is the person wrong here too. If it is such a serious offence why such ridiculously short sentences. I agree too with above statements on why were not more of them sentenced. Makes you sick to the stomach.

I agree with the other comments. The sentence for this is awful...they deserve a much longer sentence. It makes me so nervous about walking the streets on my own when people like that are around. I should be made to feel safe in my neighbourhood and surrounding areas...not made to feel that the law is behind them.

Injustice to the victim and the public by such a short prison sentence. If the victim will come forward I would think that he is justified in requesting a civil lawsuit for financial compensation he has had pain and suffering. (If the attakcers have any assets to pay the victim). Can the victim pay the solicitor costs? Good to see that CCTV has helped in the arrests in the ''No go areas'' after dark.

the sentences passed on those two is no deterent at all one will be out in 4 months the other in 6 months and while there inside or the luxury of an open nick they will be mixing with there own boasting on how they put the boot in on the unfortuanate victim and no doubt others who they have beaten up and got away with it .For mr tim shorter to mitigate as though it was a prank that went to far i think is disgusting .until we pass laws on ZERO tolerance on this behaviour involving Drink Drugs And downright Thuggery and sentences that will hopefully register in there pea brains then sadly for all of us decent people we shall continue to be fear full of these animals who have total disregard for the **** footing soft sentences in this country not just Weymouth The whole Country .

Should the victim in this case come forward he could make a claim via the Criminal Injuries Compensation Scheme and/or maybe pursue a civil action. If the Crown Prosecution Service feel that there are grounds to challenge the leniency of this sentence then they could do so (I am not sure what the grounds are that need to be met )As for Mr Shorter, he is an experienced and competent advocate and those who fall foul of the law locally seem to flock to him in droves. I look forward to the defence solicitor who rises to his feet to mitigate and says ' Your Honour, my client is an absolute waster, he has no excuse whatsoever for his actions, I can think of nothing of merit to say on his behalf and would recommend that he be removed from society for a significant period of time' - probably a short career in advocacy but how refreshing.

It was a cowardly, sustained and extreme attack by both of you fuelled by alcohol and anger. The assault was sickening and appears to have been unprovokedU know every1 including the Echo, should get the facts right befor making such comments and if thtey dont know the full stories should should not report them, The so called vicitim actually assualted 1 of the lads earlier in the night then fled, it was latet that night when they rran into him again that what happened in the video took place and that was because the victim continued to taunt the so called thugs thinking his friends would fight with him, it just turned out they wernt interested in a fight but by then the lad had bit off more than he could chew, the 2 boys went 2 far thts right but dont think the other guy wwas a victim, he hasnt come forward cause he was the cause of the trouble from the start, both wick and wheller have never been in trouble with the police and are not thugs as accused, so befor ppl and newspapers make accusations and comments they should get the facts right or they could find themselves in court on a lil charge called Slander

The assault was sickening and appears to have been unprovoked(THIS IS THE START OF MY COMMENT)you people have no idea and you dont know what your talkin about, you odnt know the full story you are only listenin to what you see on this website and in the paper. the paper does not reveal the whole story! this was an provoked attack but the start was not shown in the CCTV. all ofyou should not be judging these people they are good people and have never been in trouble before they are both nice pleasnat boys and dont deserve what you are sayin about them and how they deseve longer. they both have families who love them very much and want them home.they know they have done wrong and they are serving a very harsh sentence. be lucky that you dont have to experiece this, a loved one being senteced harsly and made example of. it was unfair. put in thir position anyone would have done the same if some one was tryin to start i you and had he cheek to hit you friend and then bump into them again and start taunting to them, he was asking for something

Violent yobs is exactly what they are. Scum, who got off with a light sentence. There can be no justification for that kind of pack behaviour and you l.e.m, sticking up for them which makes you about as 'pleasant' as them. I don't give a toss how you wanna argue it, that attack was fierce and brutal and the pair of them should have gone away for longer.

I know one of the lads ‘Wick’ and this is completely out of character. It is bad and yes he should be punished but don’t believe everything you read in the paper. The guy was not close to death and walked away from the incident. Yes this guy attacked them first but he didn’t deserve what he got. I think you should keep your comments to yourself s you don’t know the full story.

JamesYoung says...
1:59pm Tue 14 Jul 09

@sammyally : if i knifed one of your parents would you be so quick to brush it off because it was out of character?

Regardless of what the victim did, or didn't do (and we have only your word for that and i'm sorry, but i'll take what i see on CCTV over "facts" related by some anonymous friend), this gang (which at one point seems to have number at least 6 people) followed a guy who was on his own across the town and attacked him. The guy was WALKING AWAY!!

Stamping on somebody's head can and has resulted in people dying.

Do yourself a favour and don't defend the indefensible.

2:16pm Tue 14 Jul 09

@JamesYoung I think you’re over reacting when you bring knives into it. OK let me put it to you. If your friend was attacked but the guy who did it was runing away would you let him go? He did completely over react and I think alcohol was a big factor which is no excuse. People are quick to call him “Scum” without knowing the facts. This is a first offense and he would normally do the opposite but everybody has made mistakes luckily the guy wasn’t seriously hurt. He is going to prison and he will do his time which won’t be a “holiday camp”.
It seems to be a wide scale problem and this sort of thing happens all over the country because of drinking too much alcohol and pack mentality.

how can you all judge something you know nothing about these boys were attacked by this man earlier that night and he was starting on many people look at the footage again and you will see the boy infront goadding them he is in the red top incase you cant tell i do not condone what the boys did it was wronge but they are good lads with good jobs and stable lifes why not ask yourself why we keep seeing things like this in the paper like all night drinking times the reason the boy never came forward in relation to the previous ad in the echo is because he attacked them and other first with will i hope mean a charge of abh or gbh lets not judge what we dont know and think of the family and many friends of the boys that are suffering too.

Carebare,
Surely for the police to bring a charge of ABH or GBH, they would need a complaint to be made. Your friends were obviously more interested in dishing out a good shoeing and going for another pint. Did they make any complaint of assault before they were arrested ?
The guy in the red may have been in the wrong by attacking one of your friends, but two wrongs don't make a right. Attacking and chasing someone through the streets as a mob is wrong and kicking and stamping on somebody on the ground is wrong.

Sammyally, you may not recall but about 10-12 years ago, somebody died outside the White Hart, I believe due to having their head stamped on. It is a nasty, vicious assault on a prone victim not in a position to defend himself.

l.e.m - you are right in that the Echo should not have published that video, it is accessible by youngsters and I'm not sure it's a deterrent. You are also right that these are usually good lads who have done a dreadful thing, regardless of the provocation. It must be very hurtful for their families to keep having them referred to as 'Scum' who deserve to have the key thrown away. Borstal is no holiday camp and at the end of the day it'll be very hard for either lad to return to Weymouth. One night of booze, a lifetime of a criminal record and regret.

Regardless of whether this attack was provoked or not, there isn't any justification for attacking someone like this. It's amazing how the Judge can even comprehend only sentencing 9months for this,it's no deterrent whatsoever. If they were that drunk surely running down the street after the lad would have been near on impossible, let alone keeping your balance when they were kicking him.Yes this may have been their first offence, but even so it doesn't make it any better. These lads aren't much older than me and to be honest, if I was in the same position, I know for a fact I wouldn't have hunted one man down with a group of my friends and kicked the daylights out of him,no matter how drunk I was.If his provocation was that serious, get the police involved-it's their job!Referring back to the sentence-9 months, how much of this will he serve? Reductions for a guilty plea, behaving and overcrowding-well they might do 6weeks if they are unlucky! 6 weeks of playstation 3 in a holiday camp, I dread to think how they will cope.
